RLI will not specifically name a trust or an LLC as a Named Insured on the PUP policy. The RLI PUP is a personal umbrella policy designed to explicitly insure individuals and not entities. However, in accordance with the policy provisions, in many situations, our coverage can include a trust/LLC if the primary covers the trust/LLC. Therefore, if the acceptable Basic Policy lists the LLC or trust as an Additional Insured, RLI’s PUP can provide coverage for the trust/LLC subject to any other exclusions.
If it is the insured's intent to cover such non-live entities, the trust/LLC must be listed on the primary/Basic Policy as either an Additional Insured or as a Named Insured along with the individual(s) who is our Named Insured. The primary/Basic Policy cannot be solely in the name of a trust or LLC. RLI’s intent is to cover the personal exposures of our insured and the members of his household.
Finally, the LLC and/or trust would not be identified by RLI on any policy documents…we will not allow it to be the Named Insured and don’t have “Additional Insured” or “Additional Interest” endorsement forms filed to accompany this product. With the new provisions scheduled to be used as of July 2010 in most states, the word “trust” will be inserted in PART II - WHO IS COVERED - INSUREDS A. 3. so that it reads “…A trust or any other person”. In addition, we expanded B. 1. and B. 2. to include autos that are “furnished for your regular use,” which could include the LLC and trust situations where the auto is licensed in the name of the trust or LLC but regularly used by the insured.
