Completing a 1609PR and have a question? Below are some of the most commonly asked questions:

What is the 1609PR?

The 1609 PR form is the Producer's Declaration that they have completed a diligent search of the marketplace for an admitted carrier as well as an affidavit stating they have informed the insured that the risk is being placed with a surplus lines carrier.

The 1609PR is commonly referred to as 'the Affidavit' or the diligent search form.

The 1609PR form is calling for 3 (three) companies who have declined the risk. I am a captive agent - where do I get additional declinations?

Give your Tuscano underwriter a call BEFORE you return the 1609PR. They can provide you with the necessary declinations that you need. Keep in mind we cannot complete this information for you so it's important that you call us first.

Where can I find the NAIC number for a carrier?

Who should sign the 1609 PR form?

The form must be signed by the individual who placed the coverage AND that individual must also be a LICENSED PRODUCER.

The 1609PR form asks for an agency license number and a producer license number. Do I need to enter both?

Absolutely! The producer's license number must be the license number of the individual who signed the 1609PR and the agency license number is the license number of the entity they work for.

I completed the form but you sent it back, why?

The Insurance Department has taken the position that since this is a signed & sworn statement no one is permitted to alter it. If we return it to you then we will tell you what must be corrected in order for the form to be accepted.

Why are there some surplus lines accounts that I do not have to complete the 1609PR form for?

The surplus lines law has a few exceptions to the diligent search requirement. The 2 most common are for classes of business that are on the Export list and insureds whose coverage has been in the surplus lines market for 4 years without a lapse.
