I am ready for the holiday weekend – how about you? Most of you who make a habit of reading this newsletter probably know that Independence Day is my favorite holiday. We remember this day as the one the colonies declared themselves separated from the British crown. And in the process they created a messy, volatile, and imperfect state that would continuously struggle to create a more perfect union. Two hundred and thirty-five years later we have not arrived, nor do I believe we ever will. However, when the principles of liberty and freedom live on in the hearts of the American people, then there will be hope for the future of our nation and a better life for our children. O' sweet land of liberty!
So what does the future hold for our industry and the E&S industry in particular? Let me remind you that E&S insurance is the oil in the engine of economic growth. I was at a company meeting not too long ago and the topic of Data Breach Insurance came up. New regulations such as the HITECH Act that target healthcare-related industries (think of anyone under HIPPA regulations) extend the reach of not only the requirements for keeping consumer’s private information private, but also the extent of the measures that those who experience a breach must go to notify those affected and potentially affected. My personal opinion is that this coverage is going to be a critical piece of any business package. Most coverage forms will cover first party and third party damages as well as guide the policyholder through the steps necessary to remediate the breach. Life changed 10 years ago with the passage of GLB and the new standards for maintaining privacy. Healthcare providers are not the only ones who will need this coverage – eventually anyone providing services or sharing data will need it too – and so will you. The framers of the constitution might not have named privacy as a fundamental right, but in the future, you can be certain it will be protected like one.
