Acceptable Declination for Surplus Lines Pt.1

Ever wonder what you should do when you are completing the 1609PR Broker affidavit for a surplus line placement AND one of the declinations you received came from a computer rating program? Well, Tuscano asked the PSLA to elaborate on this scenario and advise us what an acceptable declination is.

According to PSLA Director, Ken Rudert, there must be a real human being that will stand behind the declination you list on the form. If you use an online rater or a company rating program and the risk is declined, you must still enter the carrier’s name – NOT the computer program or website, and a person at the company who would confirm the declination of the particular risk. 

As an example, you have the ability to rate a personal umbrella on the Tuscano website. One of the carriers we provide this tool for is RLI, an admitted carrier. If the risk comes back as ineligible for the RLI program and you instead place the business with a surplus lines carrier, you may list RLI as one of your three declining carriers. You may NOT list Tuscano, or www.tuscano.com. You may list Judi Brinton (for example), as the authorized representative for the company because if you had submitted the risk to be quoted, any one of the Tuscano underwriters would have declined the risk using the same underwriting guidelines as the computer rater.
