Civil Unions and the Definition of a Spouse

Many states are passing legislation on civil unions, domestic partnerships or other substantially similar legal relationships that are recognized in that particular state. RLI will include as a “spouse” any person who is in a legally recognized relationship with the named insured, including a civil union, domestic partnership or other substantially similar legal relationship recognized in the state where the policy is issued. The RLI Personal Umbrella has the following definitions included in our current policy provisions:
PART I – DEFINITIONS
In this policy, the words you, your, or yours mean the person named in the Declarations as the Named Insured and his or her spouse who lives in the same household.
As your insureds complete RLI’s new or renewal applications, anyone who qualifies under this broader definition of “spouse” and their exposures should be disclosed when answering the questions. When the company files updated forms in the future, the policy definitions will be revised accordingly.
